Cold calling, done legally

Calling is the fastest way to find out if a list is any good. It is also the channel with the most rules. This is the practitioner version of both, with every figure traced to a source.

A legal cold calling program scrubs numbers against the National Do Not Call Registry at least every 31 days, calls between 8am and 9pm in the prospect's time zone (Florida stops at 8pm), and keeps its own do-not-call list for five years. Vendor-reported bands run 14% to 22% live answers and 1% to 3% meetings per call.

Before the first dial

Three steps come before any rep picks up a phone: a list worth calling, a scrub, and a dialer decision.

  1. Get a verified list. A number is only useful if it is connected and belongs to the person you think. Carrier line-type data tells you whether a number is wireless or landline, whether it is active, and when it was last seen. The list guides explain how phone appends work. Pair a phone list with a property or owner list from the homeowner counts so every call has a reason.
  2. Scrub it. Register at the FTC telemarketer site, pick the area codes you call, download the registry and remove matches. The Telemarketing Sales Rule safe harbor requires a registry version no more than 31 days old before any call. Add state lists where you call and remove anyone who has told you to stop.
  3. Decide on the dialer. Since Facebook v. Duguid (decided 04/01/2021), an autodialer must be able to store or produce numbers using a random or sequential number generator. A power dialer that works a loaded list generally does not. A prerecorded voice is a separate rule whatever the dialer.

What cold calling costs

Four costs add up: the registry, the dialer seat, rep labor, and the list. Labor is the largest.

The BLS wage is a wage, not a loaded cost. Benefits, payroll tax, management and commissions sit on top, so treat it as a floor.

Worked example: cost per appointment

The inputs below with a source are published figures. The inputs marked assumed are placeholders. Replace them with your own dial logs.

  • Dialer seat: $49 per month, low end of the published power dialer range. Assumed 160 paid hours a month, so $49 / 160 = $0.31 per hour.
  • Rep wage: $17.04 per hour (BLS median).
  • Cost per rep hour: $17.04 + $0.31 = $17.35.
  • Assumed 30 dials an hour. At the 14% immediate-answer figure, 30 x 0.14 = 4.2 answered calls an hour.
  • Cost per answered call: $17.35 / 4.2 = $4.13.
  • Assumed 2% of answered calls become appointments: $4.13 / 0.02 = $206.50 per appointment.

At 1% the figure is $413. At 3% it is $138. With the $215 seat ($1.34 an hour) the cost per rep hour is $18.38 and the 2% case is $218.81. The dialer seat barely moves the result. The answer rate and the appointment rate move it a lot, and both depend on the list.

The first ten seconds

Owners decide whether to hang up almost at once. The opener that works in practice has three parts.

  1. Say your name and one true reason for the call that is about them, not you. "I'm calling about the house on Elm Street."
  2. Ask one yes or no question. "Have you thought about selling it?"
  3. Stop talking.

Scripts that open with "how are you today" or a company pitch invite the hang-up. The ask has to arrive before the prospect has to decide anything about you. Identify your business by name, and show it on caller ID. In a 12,000-person consumer survey, 73% agreed businesses should identify themselves with caller ID (Hiya, 04/14/2026, vendor-reported).

Response bands, with sources

Most published cold calling figures are vendor-reported, B2B, and weakly defined. None is measured on a homeowner list. Read them as ranges to test against, not promises. The vendor pages themselves disagree on denominators, so each row says what is counted.

The 1% to 3% figure counts meetings per call, not per conversation. Do not apply it to live conversations only.

What good numbers look like

Use these as reference lines in the first hundred dials. They come from the table above, plus the legal limit on abandoned calls.

If the answer rate lands well under the low reference in the first hundred dials, the list is the problem, not the script. Count the wrong-person and disconnected outcomes separately so that pattern is visible.

Compliance notes

These are the federal floor and one state example. The cold calling laws page, the National Do Not Call Registry guide and the TCPA explainer carry the detail.

  • DNC scrub every 31 days. Sellers must use a registry version no more than 31 days old. The FTC lists penalties of up to $53,088 per violation.
  • Cell numbers are covered. The FTC says there is no difference between cell and home numbers once listed. Business numbers are not covered (FTC consumer FAQ).
  • Manual dialing to mobiles. Autodialed or prerecorded calls to a wireless number need consent, and telemarketing needs prior express written consent (47 CFR 64.1200(a)). A person dialing by hand, with no prerecorded voice, is outside that consent rule but still inside the registry rule.
  • Hours. Federal: not before 8am or after 9pm at the called party's location. Florida: not before 8am or after 8pm, and no more than three solicitation calls to one person in 24 hours on the same topic.
  • Internal list. Honor a stop request within a reasonable time, no more than ten business days, and keep the request for five years. Keep a written policy available on request.
  • Established business relationship. 18 months after a purchase or transaction, 3 months after an inquiry.
  • State registries. Several states keep their own lists and rules. Check each state where you call before loading the dialer.
  • Private suits. The TCPA allows up to $500 per violation, up to three times that for willful or knowing violations. For registry violations, the person must have received more than one call in 12 months.
  • Recording. Consent rules vary by state. If reps call across state lines, assume all-party consent and announce the recording.

A calling sequence that pairs with mail

Questions people ask

Q01Can I cold call cell phones?

Yes, with a live person dialing and no prerecorded message, if the number is not on the registry. The registry treats cell and home numbers the same. Autodialed or prerecorded calls to a cell phone need prior consent, and written consent for telemarketing.

Q02What is the penalty for calling a number on the Do Not Call list?

The FTC lists civil penalties of up to $53,088 per violation. A person who gets more than one call in 12 months in violation of the registry rules can sue under the TCPA for up to $500 per violation, and a court may triple that for willful or knowing violations. State laws add their own remedies.

Q03Do real estate agents need to scrub expired listing and FSBO calls?

Yes, unless an exemption applies. The rules cover calls to residential numbers, and an established business relationship lasts only 18 months after a transaction or 3 months after an inquiry. A listing that expired is not a business relationship with you.

Q04How many times should I call one number?

Plan three attempts per sequence. A vendor report puts 93% of conversations by the third call, and Florida caps solicitation calls at three per person in 24 hours on the same topic. Space attempts across different times of day.

Q05What does one appointment cost from cold calling?

About $206 in the worked example on this page: the $17.04 BLS median wage plus a $49 dialer seat, 30 dials an hour (assumed), 14% answered and 2% of answers booked (assumed). At 1% booked it doubles to $413. Swap in your own dial logs before budgeting.
